Agreement
These Terms of Use ("Terms") govern access to and use of the ScaleBop website, product, and related services (collectively, the "Services") provided by ScaleBop ("we," "us," or "our"). By creating an account, importing a project, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.
ScaleBop is meant to help you understand a software project you choose to connect or upload and to produce planning and delivery artifacts—such as architecture recommendations, infrastructure as code, and CI/CD workflow drafts—so you can move toward a viable cloud deployment. The Services are a productivity and planning tool, not a substitute for your own engineering judgment, security review, compliance obligations, or operational ownership of what you deploy.
Eligibility and accounts
You must be able to form a binding contract in your jurisdiction and must not be barred from using the Services under applicable law. You are responsible for safeguarding your account credentials and for all activity under your account. Notify us promptly if you suspect unauthorized access.
Acceptable use
You agree to use the Services only in compliance with law and these Terms. Without limiting the foregoing, you will not:
- Import, analyze, or process code, data, or repositories you do not have the right to use for this purpose (for example, content you do not own, license, or have permission to access);
- Use the Services to develop, distribute, or operate malware, exploits, credential harvesting, spam, or other harmful or unlawful systems;
- Attempt to probe, scan, or test the vulnerability of the Services, breach authentication, or circumvent technical limits or security controls without our prior written consent;
- Reverse engineer the Services except to the limited extent expressly permitted by applicable law;
- Resell or sublicense the Services in a way that misrepresents their origin, or use automated means to overload or disrupt the Services.
We may suspend or terminate access if we reasonably believe you have violated these rules or if continued use would create risk to us or other users.
Your content and rights
You retain ownership of your projects, repositories, uploads, and other materials you provide ("Your Content"). To operate the Services, you grant us a limited license to host, process, transmit, display, and create derivative outputs (such as generated IaC or pipeline files) solely to provide and improve the Services for you, as further described in our Privacy Policy.
You represent that you have the rights necessary to grant the above license and that Your Content does not violate third-party rights or law. Outputs generated by the Services may incorporate patterns or suggestions informed by Your Content and product behavior; you are responsible for reviewing, testing, and adapting outputs before relying on them in production.
Generated outputs and reliance
Generated artifacts (including infrastructure code, architecture descriptions, and workflow definitions) are starting points. Cloud platforms, dependencies, and threat models change. You remain responsible for validating security, cost, availability, regulatory fit, and operational readiness of anything you deploy. The Services do not constitute legal, financial, or professional advice.
Third-party services
The Services may integrate with or depend on third parties (for example GitHub for sign-in or repository access, payment processors, hosting providers, or model providers for certain features). Your use of those services may be subject to their separate terms and policies. We are not responsible for third-party services outside our reasonable control.
Fees
Paid features, if offered, are governed by the pricing and checkout terms presented at purchase. Unless stated otherwise, fees are non-refundable except where required by law. We may change pricing or plans with reasonable notice where required.
Disclaimers
THE SERVICES AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER SCALEBOP NOR ITS SUPPLIERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100), IF YOU HAVE NOT HAD ANY PAYMENT OBLIGATIONS TO US. THE FOREGOING LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
Indemnity
You will defend and indemnify us and our affiliates, officers, directors, employees, and agents against any third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from Your Content, your use of the Services in violation of these Terms or law, or your deployment or distribution of outputs in a manner that harms others.
Changes and termination
We may modify the Services or these Terms from time to time. We will post updated Terms on this page and revise the "Last updated" date. If a change is material, we will use reasonable efforts to notify you (for example via the product or email). Continued use after the effective date constitutes acceptance of the revised Terms. You may stop using the Services at any time. We may suspend or terminate access for violations, risk, non-payment, or discontinuation of the Services.
General
These Terms constitute the entire agreement between you and us regarding the Services and supersede any prior agreements on that subject. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
